BY ACCESSING THE DELTA INVESTMENT STRATEGY SERVICE (“DELTA SERVICE”) ON THE DELTA PORTFOLIOS PTY LTD (“DELTA”) SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF USE.

1. Within 21 days of 1 March, 1 June, 1 September and 1 December, the Delta Service components will be updated and republished on the private Delta subscribers-only area on the Delta website and you will receive electronic notification of the same;

2. You agree to pay the Delta Service Subscription Fee. You hereby authorise Delta to charge you by direct debit or your credit card each quarter following delivery of the Delta Service until such time as you provide notice in writing that you wish to terminate your subscription. Such notice must be received prior to the delivery of the next quarter’s Delta Service;

3. You acknowledge that your subscription to the Delta Service allows for its use at one physical location (“Site”) by up to five investment advisers and their support staff (together “Users”) unless otherwise agreed in writing by the Delta.

4. You acknowledge that the free trial offer only applies to new subscribers. All previous clients are not eligible to claim the free trial offer;

5. You agree to use your best endeavours to prohibit any unauthorised use of your Delta Service subscription and, on becoming aware of any unauthorised use, notify Delta promptly and in writing;

6. You agree that where as a result of action or lack of action by you, the Delta Service is supplied to or obtained by persons without written authorisation, Delta shall be entitled to charge you (in addition to any other fees paid or payable by you) the Subscription Fee for each person to whom the Delta Service has been supplied or obtained whether for gain or sale or otherwise and you hereby agree to pay such Subscription Fee;

7. Wherever the Delta Service or any extract thereof is published, used, promoted or referred to by you, you agree to attribute the Delta Service in the form “Source: Delta Portfolios”;

8. Delta reserves the right to change the form and content of the Delta Service at any time without notice;

9. Delta will use their best endeavours to correct and advise you of any errors that are found to exist in the Delta Service as soon as reasonably practicable after being notified of any such error; and,

10. Delta will facilitate a Help Desk email support facility on issues relating to the Delta Service.
